A regular meeting of the Mayor and the City
Council of O'Neill was held at the City Hall in said City on the 8th day of December, 2003 at
Present:
Mayor William Price, City Attorney Boyd Strope, City Clerk/Treasurer Nikki
Johnston, Council President Ed Price and Council members; Don Baker, Lauren Hiebner, Terri Krysl,
Dwayne Philbrick, Marv Fritz, Al Vorce and Kevin Shelhamer. Absent:
None.
Notice of this meeting was given in advance
thereof according to Section 84-1408 of the Revised Statutes of Nebraska. Notice of the meeting was given to the Mayor
and all members of the Council and a copy of the acknowledgement of receipt of
notice and the agenda is attached to the minutes. Availability of the agenda was communicated
in the advance notice. All proceedings
hereafter shown were taken while convened meeting was open to the attendance of
the public.
The meeting was called to order by Mayor Price.
Moved by E. Price, second by Krysl to
waive the reading of
the minutes of November 3rd and approve
them as if read. Roll call vote as
follows: All Ayes. Motion carried.
Moved by Baker, second by Philbrick to
approve the purchase of the new ambulance with the Rural Fire Board for $98,625
(before rebate) with the funds budgeted.
Roll call vote as follows: All Ayes. Motion carried.
The Council voted for the Council President
by secret ballot.
There was one council member that received
three votes, two council members with two votes and one council member
receiving one vote.
Moved by Krysl, second by
Fritz to accept the simple majority.
Prior to the vote, Kevin Shelhamer declined
the position as Council President.
The Council voted on the next two highest
vote getters: Ed Price and Don
Baker. This resulted in a tie vote with four
votes each. The tie vote was broke by
the Mayor tossing a coin determining Ed Price as the Council President.

The final reading of this ordinance will be
placed on the January regular meeting agenda.
Water/Sewer Commissioner Kizzire stated
that at the last meeting we were asked to look at some other options for
metering. Kizzire still feels that metering
all customers is the only fair way to proceed.
City Attorney Strope stated that a meeting
was conducted at his office with Curt, Terri, Don and Marv. A decision was made to base the rates off of
a six thousand gallon use average versus ten thousand gallons. The City will charge a flat rate of $20.00
for residential and $26.50 for commercial sewer only customers. The parties that have already installed
meters will be charged based on usage and not a flat rate.
Strope
added that the Council is being asked to consider the conditions in which
meters would need to be installed. The
following conditions were discussed at the meeting:

If new
construction occurs
3.
Change
of ownership of a home
4.
New
well installed

OF THE O'NEILL MUNICIPAL CODE REGARDING SEWER USE RATES FOR USERS NOT ON THE
CITY WATER SYSTEM, REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING
FOR PUBLICATION IN PAMPHLET FORM AND PROVIDING FOR AN EFFECTIVE DATE.

Hiebner to waive the three readings on Ordinance No. 1245 and to exclude the
provision of installing a meter with a change in ownership for sewer only
customers. Roll call vote as
follows: Aye; Baker, Hiebner, Philbrick
and Fritz. Nay: Krysl, Price, Vorce and Shelhamer. Absent:
None. Motion failed.
After further discussion the following
motion was made by Council member Hiebner:

reconsider Council member Fritz’ motion to introduce Ordinance No. 1245, waive
the three readings and exclude the provision of installing a meter with a

None. Motion carried.

Library
Board Chair Vicki Cork introduced Tanci Mishler as the
new Library Director upon Patti Hering’s retirement at the end of December. Tanci is joining
the Library from

Marcia Musson
representing the Ranchland Art Group requested $650.00 to fund this year’s
activities, to begin a fund for their
scholarship program and to start planning towards
hosting a statewide convention in 2006.

by Price to approve a $300.00 donation to the Ranchland Art Group. Roll call vote as follows: All Ayes.

City Clerk Johnston reported on the grant
monies available for sirens this year.
The FEMA funds were not allocated this year for siren replacement.

by Hiebner to purchase one siren this budget year. Roll call vote as follows: All Ayes.

Mayor Price announced that the Employee
Recognition Dinner will be held on Dec. 19th.
Council member Krysl requested to table the
Grand Island Area Clean Community System Program until the January meeting in
order to research some other programs that may be available.
Troy Carlson questioned why the culvert
approved for installation at the last council meeting was not being installed.
Street Supervisor Larry Peters explained
that the installation of the culvert would cause a drainage problem for a
nearby resident that was not previously identified.
Peters stated that his department cleaned
out the ditch starting at the intersection of Putter and Par and then along the
southside of the road re-opened and cleaned out the
existing ditch following along
