A
regular meeting of the Mayor and the City Council of O'Neill was held at the
City Hall in said City on the 7th day of December, 2009 at
Present:
Mayor Bill Price, City Attorney Boyd Strope, City
Clerk/Treasurer Nikki Johnston, Council President Don Baker and Council
members; Susie Kramer, Tim Schneider, Terri Krysl, Scott Menish, Vicki Cork, Tim
Gleason and Kevin Shelhamer. Absent: None.
Notice of this meeting was given in advance
thereof according to Section 84-1408 of the Revised Statutes of Nebraska. Notice of the meeting was given to the Mayor
and all members of the Council and a copy of the acknowledgement of receipt of
notice and the agenda is attached to the minutes. Availability of the agenda was communicated
in the advance notice.
All
proceedings hereafter shown were taken while convened meeting was open to the
attendance of the public.
The meeting was called to order by Mayor
Price.
Mayor
Price informed the public of the location of the Open Meetings Act poster.

second by Menish to waive the reading of the minutes
of the November 2nd meeting and approve them as if read. Roll call vote as follows: All Ayes.

Branch Steak House and J.W’s Lounge in Spencer:
To O’Neill City Board,

the months of Jan., Feb. & March we,
at the
The New Years Eve dance would
consist of hiring a live band & serving beverages & pre-packaged chips
& other like snacks to the customers.
No minors allowed.
Wild West Weekend A two day event to include western
art, clothing, & jewelry vendors, mechanical bull riding & mechanical
surfing, western clowns, face painting, Indian drummer & dancer shows,
taxidermist displays, Coyote Caller expert, Square Dancers, Western Cake
Decorating contest, Pie Baking contest, live western band & dance Sat.
night of that weekend to include alcohol service (no minors allowed after 9
pm). We have talked with some of the
O’Neill businesses asking if they would like to set up a free vending space
& have been received with very positive feedback if the council approves
the event. This would generate income
for many of the O’Neill businesses if our turnout is as good as expected. Please consider our requests.
We have
planned & implemented other events and are experienced with crowd control,
organization, minor control (ID-ing, use of wrist bands),
noise control, control of premises, services include
Designated Driver option within a 10 mile radius after each dance &
adequate staff to manage events. Simply
put we are requesting special permission to serve food & alcohol on News
Year Eve & sponsor a two-day Wild West Weekend serving food &
alcohol. Thank You.
Mayor Price
read a statement from Kathy Winterburn regarding this
request:
It has been
brought to my attention that a bar from Spencer is going to ask for a liquor
license for New Years Eve. I would
strongly request that you consider denying this license. I feel that with all the local business
already offering events and entertainment, that we will offer enough
already. We, at the O’Neill Country Club
are having a special evening with food and a dance, not just for members but
open to guests also. We are also
providing rides to ensure that all will be safe after the evening. I wonder what an out of towner
will do except take a business from those who support our town year round. Thanks for your time and consideration.
The Council heard remarks from Andy
Dougherty, Ron Anderson and Marina Eiler.
Moved by Kramer, second by Krysl to deny a special designated liquor license for The
Long Branch Steak House and J.W’s Lounge for a New Years
Eve dance and to approve a special designated liquor license for The Long
Branch Steak House and J.W’s Lounge for a Wild West
Weekend on January 30-31, 2010 at the National Guard Armory. Roll call vote as follows: All Ayes.
Motion carried.
Dave Wetzel requested the council put
fluoridation on the next election ballot.
No action was taken.
The Gasrite
Conditional Use Permit public hearing was tabled pending Planning Commission
recommendation.

NEBRASKA, CLOSING AND VACATING BENTON STREET BETWEEN 2ND STREET AND
3RD STREET LYING BETWEEN BLOCK 5 AND BLOCK 8 IN THE ORIGINAL TOWN OF
THE CITY OF O'NEILL, HOLT COUNTY NEBRASKA; REPEALING PRIOR ORDINANCES IN
CONFLICT AND PROVIDING FOR AN EFFECTIVE DATE.

requested a written policy that states any item over $2,500 will have a spec
sheet drawn up by the supervisor and given to all of the local merchants that
sell similar merchandise.
City Attorney Strope
and City Clerk Johnston will have something written for the January meeting.
Water Commissioner Kizzire
discussed an interlocal agreement addressing the need
in the state to provide rapid, short-tem deployment of emergency services to
restore the critical operations of the affected water/wastewater and stormwater utility. The
interlocal agreement will develop a contact network
of government owned utilities to assist each other as they respond to and
recover from emergencies and non-emergency situations. An agreement will be drawn up for the January
meeting.
